Permanent Residence

Georgia Tech only sponsors individuals for Lawful Permanent Resident (LPR) status when the application is based on permanent, professional employment at Tech. Foreign national employees must meet the qualifications for one of the following categories:

  • EB-1 (Employment-based, 1st Preference), EB-1B, Outstanding Researchers and Professors
  • EB-2 (Employment-based, 2nd Preference) Special Handling PERM applications

Upon I-140 approval, the beneficiary is eligible to apply for Adjustment of Status, whereby the beneficiary adjusts their nonimmigrant status to that of permanent resident. This is a personal application and includes multiple forms. Please refer to the USCIS website for instructions: uscis.gov/greencard. The employee is responsible for filing the Adjustment of Status application and paying all applicable fees.

EB-1

For an EB-1 (Employment-based, 1st Preference) petition, the foreign national employee (FNE) must be able to establish their eligibility as an outstanding Professor or Researcher.

EB-2

Georgia Tech only files special handling EB-2 special handling (PERM) applications for permanent full-time teaching positions.

Please Note

  • State law prohibits Georgia Tech from hiring private attorneys.
  • Employees may not hire attorneys to file an immigrant petition naming Georgia Tech as the petitioner without express permission from Global HR.
  • The Manager of Global HR or his/her designee is the only authorized signatory for a Georgia Tech sponsored employment-based permanent residency petition.
